ChatGPT developer rejected the billionaire's claims outlined in a lawsuit last week. Musk argued that OpenAI allegedly focused on making money and forgot about the primary goal of developing “artificial intelligence for the benefit of humanity.”
OpenAI responded to Elon Musk's lawsuit, saying that he once wanted to gain “absolute control” of the company by merging it with Tesla.
“When we discussed a business structure, Elon wanted us to merge with Tesla so that he would have absolute control, including “a majority stake, initial control of the board of directors and the position of CEO,” according to the note on behalf of OpenAI co-founders Greg Brockman. Ilya Sutskever, John Shulman, Sam Altman and Wojciech Zaremba. “We could not negotiate a commercial deal with Elon because we believed that anyone who had absolute control of OpenAI would be against our mission.”
In the lawsuit, Musk argued that OpenAI has effectively become a “closed-source subsidiary of Microsoft” that is focused on making money rather than benefiting humanity. However, he adds that the startup abandoned the original non-profit mission it helped fund, which is a breach of contract.
Although Musk's complaint mentions a “founding agreement”, it has not been officially made public, and OpenAI's publication does not directly address the question of its existence.
OpenAI also defends its decision not to open source its creation:
“Elon understood that the mission did not involve the use of open source AGI (artificial general intelligence),” the note says.
The company released a January 2016 email exchange in which Sutskever wrote, “As we get closer to creating artificial intelligence, it would be good to be less open,” and that “it’s okay not to share research,” to which Musk provided an affirmative answer.

Musk's lawsuit includes other strange allegations, such as that GPT-4 is “Microsoft's de facto proprietary algorithm” that represents artificial general intelligence. OpenAI also rejected these claims in a separate letter to employees.
OpenAI was founded in 2015 and at that time announced that it had $1 billion in funding. Judging by the old letters published, it was Musk who proposed this figure, although he himself provided the company with less than $45 million.
“We need to use a much higher number than $100 million so as not to seem hopeless… I think we should say we're starting with $1 billion in funding… I will cover everything that other investors will not cover.”
Musk's subsequent departure and the withdrawal of promised funding became problematic for OpenAI – since the development of large-scale artificial intelligence models, such as the DALL-E image generator and the GPT series, required a lot of money. Eventually, in 2019, the startup announced the creation of a new commercial entity to fund the research and began working with Microsoft, which provided billions of dollars in funding and resources while securing exclusive licenses to use OpenAI technology in its own products.
