At the end of last year, Apple unexpectedly faced a ban on sales of Watch Series 9 and Watch Ultra 2 smartwatches, in the USA. The company filed an appeal, and now it has become known that this is a document of almost 1000 pages. 

The

916 pages Apple filed include a 68-page summary, more than 300 pages of description of the ITC decision being appealed, hundreds of pages from the Patent Office, and more. But there are the most important aspects. 

Recall that the ban was issued based on a lawsuit by Masimo Corporation, which accused Apple of violating patents. Apple notes that Masimo filed the lawsuit in 2021, when the company itself did not yet have a finished product of the same class, and as evidence of violations by Apple, the company provided the court with CAD drawings of its future smartwatches, which were eventually released only in 2022 year. Thus, Apple is trying to prove to the court that at the time the claim was filed, the plaintiff had no grounds for this.

The company also expresses concerns that if the court ultimately sides with Masimo, it will set a precedent for other companies that do not have any actual products but that have creativity and CAD software.
