In a class action lawsuit filed Friday evening in federal court in San Francisco , it is said that Nvidia used copyrighted books to train its new NeMo platform, created by the chipmaker as a “fast and affordable way to implement generative AI.”

Writers Brian Keane, Adi Nazemian and Stuart O’Nan say their work was part of a dataset of about 196,640 books and helped teach NeMo to simulate normal written speech before being removed in October “due to a reported copyright infringement.” They note that such actions indicate that Nvidia has “acknowledged” the violation.

The authors are seeking unspecified damages for people in the US whose copyrighted works helped train NeMo's large language models over the past three years. Among the works covered by the lawsuit are Keene's 2008 novel “Ghost Walk,” Nazemian's 2019 novel “Like a Love Story” and O’Nan's 2007 novella “Last Night at the Lobster”.

OpenAI previously received a similar lawsuit from Game of Thrones creator George R.R. Martin and other authors, who accused developer ChatGPT of copying their work “in bulk, without permission or consideration.”

Nvidia, meanwhile, is benefiting from relentless investor interest in AI, with shares of the chipmaker up 600% since the end of 2022. At the moment, the company's market value is close to $2.2 trillion.
