The car did not have the appropriate software installed at all
Tesla CEO Elon Musk responded to previously published information about the death of a company employee who was allegedly driving a Model 3 with FSD autopilot turned on.
He didn't use FSD. Unfortunately, the software was never downloaded. I say “unfortunately” because the accident probably would not have happened if FSD had been used.

Previously it became known that Tesla employee Hans von Ohain and his friend Eric Rossiter were involved in an accident in a Tesla Model 3, which crashed into a tree and caught fire, and Hans von Ohain died.
According to 911 records obtained by The Washington Post, Rossiter told rescuers that von Ohain was using «Tesla's Autopilot feature».
