A resident of Penza, who in 2019 purchased a Lada Niva Legend from an official AvtoVAZ dealer, appealed to the manufacturer with a demand to eliminate the identified deficiencies. During operation, pockets of corrosion, swelling, cracks and peeling of the paintwork were identified on various body elements, welds and power elements. However, the manufacturer refused to fix the problems, claiming that the warranty period had expired. A resident of Penza went to court.

As part of the lawsuit, the plaintiff asked for compensation for the cost of the car, the difference between the contract price and the price of a new similar car, a penalty, compensation for moral damages and a fine. This information was provided by the press secretary of the Penza Regional Court, Natalya Yashina.

At the trial, the plant representative did not recognize the claims of the Penza resident, claiming that the claims were filed after the expiration of the warranty period. However, the panel of judges carefully studied the case materials and came to the conclusion that the AvtoVAZ representative was wrong.

The court found the arguments about the need to calculate the warranty period from April 23, 2019 (the date of transfer of the car to the selling dealer) to be untenable. According to the court decision, the warranty period begins from the date of delivery of the car to the first customer indicated in the vehicle passport, and in this case it was March 27, 2020. It was from this date that the two-year warranty period should have been calculated.

The court upheld the claim and recovered from the manufacturer an amount of 1 million 942 thousand 438 rubles. This amount includes the cost of the car, damages, penalties, compensation for moral damage and a fine. In addition, a resident of Penza was ordered to return the faulty car to AvtoVAZ.
